New Jersey Marijuana Seeds: Legal to Use, Not to Grow

Adults 21+ can buy and possess cannabis in New Jersey, but home growing is still a crime. Here is the law and the bills that could change it.

Quick answerNot yet. New Jersey legalized adult-use cannabis by referendum in 2020, and adults 21 and older may possess up to 6 ounces, but growing cannabis at home is still illegal for adults and medical patients alike. Fewer than 10 plants can be charged as a third-degree crime. Bills to allow home grow are pending.

What New Jersey law says about growing from seed

New Jersey voters approved adult-use cannabis in November 2020, and the legislature followed with the CREAMMA law in 2021. According to the Cannabis Regulatory Commission, adults 21 and older may have up to 6 ounces of cannabis, and dispensaries may sell up to 1 ounce per transaction. Gifting up to 1 ounce to another adult without payment is also allowed.

What the law left out is home cultivation. Growing remains a crime under New Jersey’s drug statutes. NORML’s penalty summary lists fewer than 10 plants as a third-degree crime punishable by 3 to 5 years in prison and a fine of up to $25,000, with steeper penalties at 10 and 50 plants. Registered medical patients cannot grow either. Possessing more than 6 ounces is a fourth-degree crime, and the Commission reminds buyers that carrying cannabis across state lines is still illegal.

New Jersey's climate: zones, frost dates and humidity

New Jersey spans USDA zones 6b to 8a on the 2023 hardiness map. NOAA’s 1991-2020 normals give Newark a median last spring frost of April 2 and first fall frost of November 10, about 222 frost-free days. Atlantic City averages April 18 to October 29, roughly 190 days, and the hills of Sussex and Warren counties run cooler.

Summers are hot and muggy, and September can bring tropical storms up the coast. For farmers and home gardeners, the long season comes with high humidity and steady fungal pressure.

What this means for New Jersey residents

You can legally buy cannabis at a New Jersey dispensary, but you cannot legally grow it at home. That surprises many residents, since most adult-use states allow a few plants. Until the law changes, we do not recommend germinating seeds in New Jersey.

Several bills introduced on January 13, 2026 would change that. S2564 and its Assembly companion A4576 would let adults 21 and older grow up to six plants for personal use, while S1758 and A1674 focus on medical patients. As of October 17, 2026, none had passed. Similar bills stalled in past sessions, so watch the New Jersey Legislature for committee votes.

New Jersey weather by region

North Jersey’s Highlands and Skylands are the coolest part of the state, with earlier fall frost. The urban northeast around Newark and Jersey City stays warmer thanks to pavement and the Hudson. Central Jersey and the Pinelands have sandy soils that drain fast and warm quickly in spring. South Jersey and the Shore enjoy long, humid summers, sea breezes and the occasional coastal storm.

Storing and collecting seeds legally

If you are holding seeds until New Jersey legalizes home grow, or you plan to grow in a state where it is already allowed, start with our guide on whether marijuana seeds are legal in the US. State law and federal rules both apply, and federal treatment of viable seeds is scheduled to change on December 11, 2026.

Where possession is lawful, a sealed container with a desiccant, kept in a refrigerator, keeps seeds viable through a long wait. Label each batch with its type and purchase date. Our seed storage guide covers the best containers and humidity levels for multi-year storage.
