Terms and Conditions

These Terms and Conditions (“Terms”) are a legal agreement between you and Best Marijuana Seeds (“we,” “us” or “our”), the operator of bestmarijuanaseeds.com (the “Site”). By using the Site, creating an account or placing an order, you agree to these Terms, our Privacy Policy and our Legal Disclaimer. If you do not agree, do not use the Site.

You must be at least 21 years old to use the Site or buy from us. By using the Site, you confirm that you are 21 or older. We may ask for proof of age, and we may cancel any order or close any account if we believe the buyer is under 21.

We ship only to addresses in the United States and do not accept orders for delivery outside the US. We may decline to ship to any address or location, including where we believe a shipment would break the law of that place.

Cannabis laws differ between federal, state and local governments, and they change often. You alone are responsible for knowing and following every law that applies to you, including laws on buying, possessing, germinating and growing cannabis seeds, home grow plant limits and where plants may be grown. Do not order if it would be illegal for you to receive or possess seeds where you live.

Federal law on seeds is changing. Section 781 of H.R. 5371 (Public Law 119-37) excludes viable seeds from cannabis plants above 0.3% total THC from the federal definition of hemp. Nothing on the Site is legal advice. If you are unsure whether you may buy, possess or grow seeds, talk to a lawyer licensed in your state.

Strain descriptions, spec sheets and photos are general information. Figures such as THC and CBD percentages, genetics ratios, flowering time, yield, height and difficulty are typical ranges based on breeder information and grower reports. Your results depend on genetics, phenotype, growing conditions and experience, and they will vary.

We do not guarantee any specific THC or CBD level, yield, effect, flavor or flowering time, and we cannot guarantee that every feminized seed will grow into a female plant. Effects described on the Site are commonly reported experiences, not medical claims. Photos are illustrations and may not show the exact seeds or plants you receive.

Seeds are sold in 5, 10 and 25 seed packs. Every strain uses the same price ladder: $65 for a 5-pack, $120 for a 10-pack and $240 for a 25-pack. All prices are in US dollars. We may change prices at any time, but a change will not affect an order we have already accepted. Any sales tax that applies is calculated at checkout.

We work to keep product, price and stock information accurate, but mistakes happen. If an item is listed at the wrong price or with wrong information, we may cancel the order and refund any amount charged, even after you receive an order confirmation. We may also correct errors on the Site at any time without notice.

When you place an order, you are offering to buy the items in it. Our confirmation email means we received your order. We accept the order when we ship it. We may refuse, limit or cancel any order, for example if an item is out of stock, payment is declined, we suspect fraud, the buyer appears to be under 21, or the shipping address is outside the United States.

Payment is taken by our third-party payment processors when you order. If we cancel an order after payment, we refund the amount charged to your original payment method.

To cancel an order, email support@bestmarijuanaseeds.com as soon as possible. Orders placed before 1pm Central Time ship the same business day, so we may not be able to cancel an order that has already been packed or shipped. If we cancel an unshipped order at your request, we refund it in full. Orders that have shipped are covered by the returns terms below.

Unopened, untampered orders can be returned. Once we receive the returned order, we refund the order total minus shipping to your original payment method. Opened packs cannot be returned. Seeds that fail to germinate are handled under our germination guarantee below, not through refunds. To start a return, email support@bestmarijuanaseeds.com with your order number. Buy one, get one free (BOGO): every 10-seed and 25-seed pack comes with a free pack. The free pack is added automatically at checkout, no code needed, and you choose any strain for it. 5-seed packs are not included in BOGO. See BOGO deals.

Email subscribers receive news of strain drops and restocks, and may receive members-only promotions. Any promotion’s terms are shown with the offer.

The offer details shown on the Site when you place your order apply to that order. Free packs have no cash value and cannot be exchanged for cash. We may change, limit or end any offer at any time, but changes will not affect orders already placed. We may cancel discounts or free items obtained by mistake, through fraud or in breach of these Terms.

Every seed that fails to sprout is replaced one for one, free, including free BOGO seeds. To qualify, germinate your seeds with our paper towel method (see our germination guide) and allow up to 10 days. Submit your claim within 30 days of delivery with your order number and a photo of the seeds in the germination setup. You do not need to return the failed seeds. Replacements ship free with our next dispatch.

The guarantee covers germination only. Coverage ends once a seedling is above the soil, so it does not cover later growth, yield, potency or plant sex. Full details are on our Germination Guarantee page.

Shipping is free on orders over $200 (before taxes). Orders under $200 ship by USPS Priority for $20. Delivery within the US usually takes 5 to 7 business days, and we email a tracking number for every order. Orders placed before 1pm Central Time ship the same business day. Delivery times are estimates, not guarantees, and we are not responsible for carrier delays. See our Shipping page for details.

Please check your shipping address before you order. We are not responsible for packages sent to an address you entered incorrectly. To the extent the law allows, risk of loss passes to you when we hand your package to the carrier. If tracking shows a package is lost or has stopped moving, contact us and we will help you with the carrier and review your options.

Packages can be delayed, opened, held or seized by carriers or government authorities. You accept the risk of shipping to your location. We are not responsible for packages held or seized by any authority, or for any consequence of receiving seeds where they are not allowed.

If you create an account, keep your password confidential and give us accurate information. You are responsible for activity under your account. Tell us right away if you think someone has used it without permission. We may suspend or close accounts that break these Terms.

All Site content, including text, spec sheets, graphics, logos and images, belongs to us or our licensors and is protected by intellectual property laws. You may view and print pages for personal, noncommercial use. You may not copy, scrape, resell or republish Site content without our written permission, use the Site for any unlawful purpose, interfere with its security or operation, or submit false orders or reviews.

If you post a review or other content, you confirm it is honest and based on your own experience. You give us a nonexclusive, royalty-free, perpetual license to display it on the Site and in our marketing, and to shorten or format it without changing its meaning. We may remove content that breaks these Terms.

Except for our germination guarantee and any warranty the law does not allow us to exclude, the Site and all products are provided “as is” and “as available.” To the fullest extent the law allows, we disclaim all other warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not promise that the Site will be error-free or always available.

To the fullest extent the law allows, we and our owners, employees and suppliers are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, lost crops or lost data, arising from your use of the Site or our products. This includes any fine, penalty or other legal consequence resulting from your purchase, possession, germination or cultivation of seeds.

Our total liability for any claim related to an order is limited to the amount you paid for that order. Some states do not allow certain limits on liability, so some of these limits may not apply to you.

You agree to defend, indemnify and hold harmless Best Marijuana Seeds and its owners, employees and suppliers from any claims, damages, fines and costs, including reasonable attorneys’ fees, arising from your breach of these Terms or your violation of any law, including laws on the possession or cultivation of cannabis.

These Terms are governed by the laws of the state in which Best Marijuana Seeds is organized, without regard to its conflict of law rules, except where federal law applies. Any dispute arising from these Terms, the Site or your order will be resolved in the state or federal courts located in that state, and you and we consent to their jurisdiction, unless the law of your state requires otherwise.

Before filing a claim, please email support@bestmarijuanaseeds.com so we can try to resolve the issue informally.

We may update these Terms from time to time. The “Last updated” date at the top shows when they last changed. Updated Terms apply to Site use and orders after they are posted. The Terms in effect when you placed an order apply to that order.

If any part of these Terms is found unenforceable, the rest stays in effect. Our failure to enforce a term is not a waiver of it. These Terms, together with the policies they reference, are the entire agreement between you and us about the Site and your orders. You may not transfer your rights under these Terms; we may transfer ours as part of a sale or reorganization of our business.
