What Delaware law says about growing from seed
Delaware legalized adult use in 2023 through two bills: HB 1, which made possession of a personal use quantity legal for adults 21+, and HB 2, which built the licensed market. Lawmakers left home cultivation out of both bills. The Office of the Marijuana Commissioner FAQ answers the question “Can I grow my own marijuana plants?” with a simple no.
The medical program draws the same line. The FAQ states that patients and caregivers are not authorized to grow or cultivate marijuana. Patients may instead buy three ounces of usable marijuana every 14 days from licensed businesses.
Growing plants falls outside the personal use protections in HB 1, so it can still lead to criminal charges. Possession is protected only up to the personal use quantity: 1 ounce of leaf marijuana, 12 grams of concentrate, or products containing up to 750 milligrams of delta-9 THC.
What this means for Delaware residents
If you’re 21 or older, you can now buy cannabis legally. The state announced that adult-use sales began on August 1, 2025, starting with medical operators that converted their licenses, with more licensed retailers slated to follow. You may carry and keep up to the personal use quantity, and you can make your own extracts at home using water, glycerin, vegetable oil or food-grade ethanol.
What you can’t do is grow. Delaware remains one of the few adult-use states without any home grow right for adults or patients, and we found no bill enacted to change that as of October 2026. Check the Commissioner’s office for updates before you plan a garden.
Remember the border, too. The FAQ notes it is illegal to bring marijuana products into or out of Delaware, even from neighboring legal states such as New Jersey or Maryland, and that rule covers products bought at licensed stores.
Delaware's climate, for the record
The 2023 USDA map places nearly all of Delaware in zone 7b, with a sliver of 7a near Newark and zone 8a along the Atlantic and Delaware Bay shoreline in Sussex County. Wilmington’s median last frost is April 7 and its first fall frost is around November 1, about 209 frost-free days. Dover and Georgetown get about 214 to 217.
No spot in the state is more than 8 miles from tidal water, so the bay and ocean shape everything. Summers are warm and humid, Wilmington averages July highs near 87°F, and July through October each bring about 4 inches of rain.
Tropical storms and hurricanes occasionally reach Delaware in late summer and fall. Combined with humid nights, that gives the state moderate to high mold pressure for dense-flowering garden plants during September and October. Mean annual temperatures climb from about 54°F in the north to 58°F on the southern coast.
Storing and collecting seeds legally in Delaware
Delaware is unusual: adults 21+ may legally possess cannabis, yet they may not germinate a seed. Seeds are generally treated as part of the cannabis plant under state law, so any you keep should stay within the personal use quantity and stay unplanted. Federal rules are shifting too, so read our guide on whether marijuana seeds are legal in the US before you buy.
If you hold seeds for a future move or a possible change in state law, store them properly. Use an airtight container with a desiccant pack, keep it dark and cool at 40°F to 50°F, and avoid basements that turn damp in the humid Mid-Atlantic summer. A closet shelf on an inside wall, or a sealed jar in the refrigerator, usually works better.
Well-stored seeds can stay viable for several years. Our seed storage guide explains how to check them over time.
