Georgia and Marijuana Seeds: The 2026 Legal Picture

Georgia's medical program just expanded, but growing cannabis at home is still a felony.

Quick answerNo. Georgia does not allow anyone to grow marijuana from seed, including registered medical cannabis patients. Cultivation is a felony. A 2026 law expanded the medical program with stronger products and vaporization for patients 21+, but it kept the ban on smoking and home growing.

What Georgia law says about growing from seed

Georgia has never allowed home cultivation. Its medical program began in 2015 as a narrow low-THC oil registry, and a 2019 law created licensed in-state producers overseen by the Georgia Access to Medical Cannabis Commission. Registered patients buy from those licensed businesses and nowhere else.

Outside that program, marijuana remains a controlled substance. Under Georgia law, growing any amount is treated as manufacturing, a felony, and NORML lists a sentence of 1 to 10 years for the smallest tier. Possessing an ounce or less is a misdemeanor punishable by up to a year in jail and a $1,000 fine, and larger amounts are felonies.

Seeds offer no legal loophole. Georgia’s definition of marijuana is broad, only sterilized seeds that can’t germinate are generally excluded, and the federal status of viable high-THC seeds is changing too. Planting cannabis seeds in Georgia is illegal cultivation.

What this means for Georgia residents

The big 2026 change is for patients. The Putting Georgia’s Patients First Act (SB 220), signed in May and in effect since July 1, 2026, replaced the old 5% THC cap with a possession limit of 12,000 milligrams of THC, as NORML summarized. Patients 21+ may now vaporize permitted products, but smoking and combustion remain prohibited.

The law also renamed low-THC oil as medical cannabis throughout the state code and broadened who qualifies. According to WABE, regulators expect the changes to draw more patients, and the Commission approved a home delivery rule in October 2026, with shipments expected to start after a final administrative review.

None of this touches home growing. If you’re a registered patient, buy only from licensed dispensaries. If you’re not, there is no legal adult-use market in Georgia, and a few cities’ reduced local penalties for small possession don’t change state law.

Georgia's climate, for the record

Georgia spans USDA zones 7b in the Blue Ridge to 9a along the coast, and Atlanta sits in 8a. Atlanta’s median last frost is March 15 and its first fall frost is November 20, about 252 frost-free days. Savannah gets about 270, while Blairsville in the mountains gets about 176.

Summers are long, hot and humid. Macon averages 91% relative humidity on summer mornings, and Atlanta picks up more than 13 inches of rain from June through August. Afternoon thunderstorms are a near-daily summer pattern statewide, and tropical storm remnants can dump heavy rain in late summer and fall.

For dense-flowering plants of any kind, that adds up to high mold pressure from July into October. The coast is the most humid region, and Middle Georgia cities such as Macon and Columbus average about 20 days a year above 95°F, which stresses most garden crops.

Storing and collecting seeds legally in Georgia

Because cultivation is a felony in Georgia, viable cannabis seeds have no legal use for planting here. If you collect seeds as a keepsake or because you plan to move to a state with legal home growing, first read our guide on whether marijuana seeds are legal in the US, which covers the federal Section 781 change.

Where possession is permitted, the goal is to slow aging. Seeds last longest when sealed in an airtight glass vial or bag with a desiccant pack, kept dark and cool at 40°F to 50°F. Georgia’s muggy summers make a sealed container essential, since a few weeks of humid air in a warm cabinet can sharply reduce germination rates.

Write the strain name and purchase date on every container, and open it only when you truly need to. See our seed storage guide for step-by-step instructions.
