Wisconsin Marijuana Seeds: The Law in a State Surrounded by Change

Three neighboring states allow adult use, but Wisconsin still bans growing. Here is the law, the latest bills and the Badger State climate.

Quick answerNo. Wisconsin has no medical or adult-use marijuana law, and growing even a few plants can be charged as a felony. The only exception lets people possess CBD oil with a physician's certification. Medical and adult-use bills both died in the state Senate in March 2026.

What Wisconsin law says about growing from seed

Marijuana is a Schedule I drug under Wisconsin Statutes Chapter 961, and growing it counts as manufacturing. According to NORML’s Wisconsin summary, even four or fewer plants can be charged as a felony with up to three and a half years in prison and a $10,000 fine, and the penalties climb with plant count.

Possession is a misdemeanor on a first offense, with up to six months in jail and a $1,000 fine. A second offense can be charged as a felony. Madison, Milwaukee and other cities have lowered local fines for small amounts, but those ordinances do not cover growing and state charges remain possible.

The only medical exception is for CBD oil, which people may possess with a physician’s certification. Governor Evers has put legalization in several budgets, and Republicans have removed it each time. In 2026, the Senate’s own medical bill, SB 534, failed to pass when the session ended.

Wisconsin's climate: lake shore, driftless hills and the north woods

The 2023 USDA map moved Wisconsin half a zone warmer. A new zone 6a now runs along the Lake Michigan shore, including Milwaukee, while Madison shifted mostly to 5b, according to UW Extension. The north woods sit around 3b to 4a, where frost can return in early September.

Milwaukee’s median last frost is April 19 and its first fall frost is about October 29, roughly 192 frost-free days, because the lake keeps the shore mild in autumn. Inland Madison has about 160 days, from May 1 to October 10, and northern counties get less.

Summers are warm and humid, and September and October nights bring heavy dew. That moisture leads to powdery mildew and mold on garden crops statewide. The hilly Driftless Area in the southwest has frost pockets in its valleys, where cold air pools on clear nights while the ridgetops stay several degrees warmer.

What this means for Wisconsin residents

Every Wisconsin county follows the same state rule: no marijuana plants at home, for anyone. Buying cannabis in Illinois, Michigan or Minnesota and bringing it home is also illegal under state law.

Change depends on the legislature. Assembly and Senate Republicans have disagreed over how a medical program should work, and the next session starts in January 2027.

Reading Wisconsin's growing season

Wisconsin’s licensed hemp growers show the state’s limits clearly. Fields near Lake Michigan enjoy a longer fall, while central sands and northern farms race early frost, and heavy dew at harvest time is a constant concern across the state.

Collecting and storing seeds where the law permits

With three adult-use states on its borders, Wisconsin has residents who keep seeds for a planned move. Our explainer on US marijuana seed laws covers the federal change for viable high-THC seeds scheduled for December 2026.

Where you may lawfully keep them, avoid garages and porches that freeze and thaw all winter. A sealed jar in the refrigerator, with a desiccant pack, keeps seeds dormant, and our seed storage guide explains why. Germinating them in Wisconsin is illegal.

Wisconsin marijuana seed FAQ

Is it legal to grow marijuana in Wisconsin?

No. Growing marijuana is treated as manufacturing a controlled substance. Even four or fewer plants can be charged as a felony with up to three and a half years in prison and a $10,000 fine.

Does Wisconsin have medical marijuana?

No. Wisconsin only allows possession of CBD oil with a physician's certification. A Republican-backed medical bill, SB 534, failed to pass the Senate when the 2025-2026 session ended in March 2026.

Is marijuana decriminalized in Milwaukee or Madison?

Both cities have reduced local fines for small amounts, but state law still makes possession a misdemeanor on a first offense. Municipal fines cover small possession only, and a county sheriff can still file state charges for any grow.

Can I bring marijuana from Illinois or Michigan into Wisconsin?

No. Cannabis bought legally in a neighboring state is still illegal to possess in Wisconsin, and carrying it across state lines also violates federal law. That applies to edibles, vapes and flower alike.

Can I buy marijuana seeds in Wisconsin?

Wisconsin treats a sprouted plant as manufacturing, which is a felony even at four plants or fewer. Seeds also face a federal change: on December 11, 2026, Section 781 of H.R. 5371 updates how viable high-THC seeds are treated. Read our legality guide before any purchase.
