Mississippi Marijuana Seeds and the Medical Cannabis Act

Mississippi patients can buy medical cannabis, but growing it at home is off the table. Here is the law and what it means for you.

Quick answerNo. Mississippi's Medical Cannabis Act, passed in 2022, does not let patients or anyone else grow cannabis at home. Registered patients buy from licensed dispensaries, up to 3 ounces of flower a month. For non-patients, a first offense for 30 grams or less is a fine, but plants are penalized by total weight.

What Mississippi law says about growing from seed

The Mississippi Medical Cannabis Act became law in February 2022, after the state Supreme Court struck down a voter-approved initiative. The Mississippi Medical Cannabis Program, run by the State Department of Health, registers patients, caregivers and growers, and NORML’s program summary confirms that home cultivation is not allowed. Patients may buy up to 3.5 grams of flower a day, capped at 3 ounces a month.

Outside the program, Mississippi has long treated small amounts as a fine-only offense: a first offense for 30 grams or less carries a $100 to $250 fine, and a second offense can bring 5 to 60 days in jail. Only licensed cultivation facilities may grow plants for the program. But NORML’s penalty summary explains that cultivation is punished by the combined weight of the plants, and a few plants can quickly push a case into felony territory.

Mississippi's climate: zones, frost dates and humidity

Mississippi spans USDA zones 7b to 9a on the 2023 hardiness map. NOAA’s 1991-2020 normals give Jackson a median last spring frost of March 14 and first fall frost of November 14, about 245 frost-free days. Tupelo in the northeast averages about 235 days, while Gulfport on the coast gets roughly 287.

Hot, humid summers with frequent thunderstorms define the state, and tropical storms can arrive from June into November. For gardeners and licensed farmers, that means long growing seasons paired with constant fungal and insect pressure.

What this means for Mississippi residents

If you are not a licensed cultivator, growing marijuana in Mississippi is illegal, with or without a medical card. We do not recommend buying seeds to plant here, and possession outside the program is still an offense.

Patients with a qualifying condition can get a certification from a registered practitioner, apply for a card through the Department of Health and buy from licensed dispensaries, which opened to patients in 2023. Dispensaries are licensed by the Department of Revenue.

The 2026 legislative session focused on program details, such as how long cards stay valid and whether terminally ill patients can use cannabis in hospitals. None of the bills we reviewed would allow home cultivation or adult use.

Mississippi weather by region

The Delta in the northwest is flat, fertile and humid, with hot summer nights. Northeast Mississippi around Tupelo has more hills and a slightly shorter season. The Pine Belt around Hattiesburg is warm and wet, and the Gulf Coast around Gulfport and Biloxi rarely freezes but sees the most tropical weather. Across the state, heavy summer rain and dew make fungal disease the main concern for any garden crop.

Storing and collecting seeds legally

Some Mississippians keep seeds as collectibles or plan to grow after moving to a state that allows it. Whether you may hold seeds depends on state law and on federal rules scheduled to change on December 11, 2026, explained in our guide on whether marijuana seeds are legal in the US.

Where possession is permitted, protect seeds from Mississippi’s humidity. Keep them sealed with a desiccant, in a refrigerator rather than a shed, and away from light. Our seed storage guide covers containers and humidity targets.

Do not germinate seeds in Mississippi, since a sprouted seed counts as a plant.
